"As a condition to issuance of any permit to proceed with construction of a Principal Solar Energy Facility, the Owner of the Principal Solar Energy Facility shall provide Financial Security in a form and amount acceptable to Turbett Township as described herein: i. Turbett Township shall be a beneficiary of the Financial Security; ii. The Financial Security shall secure the obligations to decommission the Principal Solar Energy Facility and may be used by Turbett Township to pay for decommissioning the Principal Solar Energy Facility if the Owner of the Principal Solar Energy Facility does not comply with the decommissioning requirements set forth herein; iii. The Financial Security shall be in an amount equal to 110% of the estimated costs of decommissioning activities. The estimated costs of decommissioning activities may include an estimated salvage and resale value, discounted by a factor of 10%. The decommissioning cost estimate formula shall be: gross cost of decommissioning activities minus 90% credit of salvage and resale value equals the decommissioning cost estimate. iv. The amount of the estimated costs to decommission the Principal Solar Energy Facility shall be reviewed and updated every five years by a third-party professional engineer registered in the Commonwealth of Pennsylvania. The professional engineer shall be retained by the Owner of the Principal Solar Energy Facility and satisfactory to Turbett Township. The review shall take into account factors such as inflation and changes in costs, values and legal requirements. The report of the professional engineer shall be provided to Turbett Township for review and approval. The amount of the Financial Security shall be adjusted based on the report of the professional engineer within 30 days after approval of the report by Turbett Township. v. Any estimates of the costs to decommission the Principal Solar Energy Facility shall be subject to review and approval by Turbett Township. The Owner of the Principal Solar Energy Facility shall be responsible for all costs incurred by Turbett Township for such review, including administrative, legal and engineering costs associated with such review."
